Liability for Content
As a service provider, we are responsible for our own content on these pages in accordance with general laws pursuant to § 7 (1) of the German Telemedia Act (TMG). According to §§ 8 to 10 TMG, however, we as a service provider are not obligated to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information under general laws remain unaffected by this. Liability in this respect is only possible from the time of knowledge of a specific legal violation. Upon becoming aware of such legal violations, we will remove this content immediately. Linkstars acts as an intermediary for users and concludes brokerage agreements with both brands/agencies and influencers. The contractual agreement for the respective campaign is then concluded directly between the respective brand/agency and the influencer, with the terms being negotiated and agreed upon directly between those parties. Linkstars therefore assumes no liability for contracts concluded between users, even if the contact was established through Linkstars, as Linkstars is not a party to these contracts.

Linkdstars does not act as an agency itself and does not interfere in the contract negotiations or in the content of the agreement between influencers and brands/agencies. Rather, Linkdstars merely facilitates and enables the conclusion of contracts between brands/agencies and influencers.

Linkdstars thus acts as an intermediary both in the name and on behalf of the influencers and in the name and on behalf of the brands/agencies. Linkdstars is therefore a commercial agent. The duration of the commercial agency relationship is tied to the term of the user agreement and automatically ends with it.

The influencer is liable to Linkdstars and the partner for all damages incurred by Linkdstars or the partner as a result of a breach of contract attributable to the influencer.

The influencer is aware that technical maintenance may cause temporary outages of the platform. No claims may be made against Linkdstars due to such outages, provided they remain within a reasonable scope. If third parties assert claims against Linkdstars and/or the partner due to the publication of content—based on violations of copyright, trademark rights, personal rights, rules against unfair competition, or other legal provisions—the influencer shall indemnify Linkdstars and/or the partner against all such claims.

Furthermore, the influencer agrees to reimburse all costs incurred by Linkdstars or the operator of a partner shop as a result of such third-party claims. Reimbursable costs include the expenses of appropriate legal defense.

The influencer also agrees to pay a contractual penalty for each culpable violation of obligations arising from this agreement. The amount of this penalty shall be determined at the reasonable discretion of Linkdstars and shall be subject to judicial review in case of dispute. The assessment will primarily depend on the significance of the breached obligation, the harm suffered by the affected contracting party (including non-material damage), the severity of the breach, and the degree of fault of the influencer. Any further claims for damages remain unaffected by this provision.

Liability for Links
Our website contains links to external third-party websites over which we have no control. Therefore, we cannot assume any liability for this external content. The respective provider or operator of the linked pages is always responsible for their content. The linked pages were checked for possible legal violations at the time of linking. No illegal content was identifiable at the time of linking. However, permanent monitoring of the content of linked pages is not reasonable without concrete evidence of a legal violation. If we become aware of legal violations, we will remove such links immediately.
